Terms of Service

1. Acceptance of Terms

By accessing or using MooChatAI's services, website, API, and plugins (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MooChatAI provides an AI-powered shopping assistant for WordPress & Shopify stores. The Service includes:

  • A WordPress plugin and Shopify app that embed a chat widget on your store
  • AI-powered product recommendations and customer support
  • Product catalog synchronization and vector search
  • Analytics and reporting dashboard
  • Human agent handoff capabilities (premium plans)
  • Knowledge base and custom training for AI responses

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials, API keys, and license keys. You must notify us immediately of any unauthorized use.

4. Plans and Pricing

4.1 Free Plan

The free plan includes limited features and usage. We reserve the right to modify free plan limits at any time.

4.2 Paid Plans

Paid plans are billed through Stripe (WordPress) or the Shopify Billing API (Shopify). Prices are subject to change with 30 days' notice. All payments are non-refundable except as required by law or by the applicable platform's refund policies.

4.3 Usage Limits

Each plan has defined limits for products, chat sessions, and agent seats. Exceeding these limits may result in degraded service until the next billing cycle or plan upgrade.

5. Acceptable Use

You agree not to:

  • Use the Service for illegal activities
  • Attempt to reverse-engineer, decompile, or hack the Service
  • Abuse rate limits or attempt denial-of-service attacks
  • Share API keys or credentials with unauthorized parties
  • Use the Service to transmit spam, malware, or harmful content
  • Scrape, crawl, or bulk-download data from the Service
  • Resell or redistribute the Service without authorization

6. AI-Generated Content

The chat responses are generated by artificial intelligence and may not always be accurate. You acknowledge that:

  • AI responses are provided "as-is" without warranty of accuracy
  • You are responsible for reviewing AI-generated content on your store
  • MooChatAI is not liable for purchasing decisions made based on AI recommendations
  • You should configure custom training data to ensure accurate responses for your store

7. Data Ownership

  • Your Data: You retain ownership of your product data, chat transcripts, and store information
  • License Grant: You grant us a license to use your data solely for providing and improving the Service
  • Aggregated Data: We may use anonymized, aggregated data for analytics and service improvement

8. Intellectual Property

The Service, including its code, design, and branding, is owned by MooChatAI. The plugins are licensed for use on your authorized domains only. You may not copy, modify, or distribute any part of the Service.

9. Service Availability

We strive for high availability but do not guarantee 100% uptime. We may perform maintenance with or without prior notice. We are not liable for losses caused by service interruptions.

10. Termination

  • You may cancel your WordPress subscription at any time through the Stripe customer portal
  • You may cancel your Shopify subscription by uninstalling the app from your Shopify admin; the Shopify recurring charge will be cancelled automatically
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, your data will be retained for 30 days before deletion
  • When a Shopify shop data erasure request is received, all associated data is permanently deleted
  • Free accounts inactive for 12 months may be automatically deleted

11. Limitation of Liability

To the maximum extent permitted by law, MooChatAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless MooChatAI from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Shopify App Users

The following additional terms apply to merchants who install MooChatAI from the Shopify App Store:

  • By installing the app, you authorize MooChatAI to access your Shopify store data (products, orders, pages, and blog posts) as needed to provide the Service
  • Billing for Shopify plans is managed through the Shopify Billing API; charges appear on your Shopify invoice
  • Uninstalling the app cancels any active subscription and marks your installation as inactive
  • We comply with all Shopify mandatory GDPR webhooks for customer data requests, customer data erasure, and shop data erasure
  • The chat widget is embedded on your storefront via a Shopify theme app extension; removing the app block from your theme disables the widget without uninstalling the app
  • Your use of MooChatAI is also subject to the Shopify Terms of Service

14. Changes to Terms

We may modify these Terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration.
